Terms & Conditions
Last updated: 11 October 2026
These terms apply when you use any website, app, platform, API, portal or system operated by 389 Group Ltd or a company in the 389 group (the "services"). In these terms, "we" and "us" mean 389 Group Ltd and the group company that operates the service you use. We are based in Lilongwe, Malawi. These terms are governed by the laws of the Republic of Malawi, including the Electronic Transactions and Cyber Security Act, 2016 and the Consumer Protection Act.
By accessing or using a service, creating an account, or sending us an enquiry, you agree to these terms. If you use a service for a business, you confirm you are authorised to bind that business.
1. Services covered
These terms cover every service we operate, including new services from the day they launch, whether or not they are named here. Examples:
- 389 Group website (389group.ltd)
- 389 Agency (389agency.com)
- 389 Xperience (389xperience.com)
- Konnect (konnect.389xperience.com)
- 389 Tickets (389tickets.com)
- Steadi Pay (steadipay.ltd)
- 389 Konvert
A service may link to this page from its sign up, checkout, footer or settings. That link is how these terms are made available to you for that service.
2. Product specific terms
Some services have extra terms because they handle money, tickets or partner relationships. Where a service has its own terms, they add to these ones. If there is a conflict on that service, the service terms win for that service only. Current examples:
- 389 Tickets: ticket sales, commission, payouts, resale
- 389 Tickets refunds: refund policy
- Steadi Pay: payments, fees, invoices, API use
Work we do for a client under a written proposal, statement of work or service agreement is governed by that document first, then by these terms.
3. Who may use our services
- You must be 18 or older and able to enter a contract under Malawian law.
- You must give true, current details when you register or contact us.
- One person per account unless the service says otherwise. Do not share your login.
4. Accounts and security
You are responsible for your passwords, authenticator codes, passkeys, API keys and webhook secrets, and for activity under your account. Keep them off shared devices. If you think an account or key is compromised, tell us at gilson@389group.ltd straight away and revoke the key where the service lets you.
We may suspend or close an account if these terms, the law, or a partner's rules are broken, or to protect other users or the service.
5. Acceptable use
You must not:
- break the law, or use our services for fraud, money laundering or other unlawful activity;
- attempt unauthorised access, probe or test our systems without written permission, or interfere with the service;
- upload malware, scrape the services at scale, or overload them;
- submit false, misleading or infringing content, or personal data you have no right to share;
- resell or sublicense access without our written agreement;
- store card numbers, CVVs or PINs in our systems or yours when using our payment tools.
Security researchers acting in good faith can report issues to gilson@389group.ltd. Please give us reasonable time to fix a problem before you disclose it.
6. Your content and files
Some services let you upload, enter or generate content, such as files, documents, images, text, data and settings. You keep ownership of it. You give us a limited licence to host, store, process, convert, transmit and display it only so far as needed to run the service for you and to keep it secure.
- You confirm you have the right to upload your content and that it does not break the law or anyone's rights.
- You are responsible for keeping your own copies. Do not rely on a service as your only backup.
- Files and outputs may be deleted automatically after a retention period the service states, or when you delete them or close your account.
- We may remove content that breaks these terms or the law.
7. Payments, fees and tickets
Where a service takes payment or sells tickets, prices, fees and taxes are shown before you pay. Payments are collected by licensed payment partners such as mobile money operators, banks and card processors, under their own terms. We do not hold your funds and we do not see or store full card numbers, CVVs or PINs.
Fees, commission, payouts, refunds and resale rules are set out in the service's own terms where it has them (see section 2). Unless those terms or the law say otherwise, completed purchases are final.
8. Intellectual property
The services, software, brand names, logos, designs and our own content are owned by 389 Group Ltd, its group companies or their licensors, and are protected by law. We give you a limited, non-exclusive, non-transferable right to use the services for their intended purpose. Our brand assets may only be used as set out on our brand page or with our written consent.
Unless a written agreement says otherwise, ownership of bespoke work we create for a client passes to the client once we have been paid in full. We keep our pre-existing tools, code libraries and know-how.
9. Enquiries and proposals
Messages sent through contact or careers forms are non-binding. Scope, price and delivery are agreed in writing before work starts.
10. Third party services and links
Our services may link to or depend on third party services, including payment partners, hosting, email, maps and analytics. We are not responsible for their content or availability, and their own terms apply to your use of them.
11. Availability and changes
We aim for a working, secure service but do not promise uninterrupted availability. Scheduled maintenance, partner outages and events outside our control can cause delays. Services marked beta, preview or early access may change or stop at any time. We may change, suspend or retire a feature with reasonable notice where we can give it.
12. Liability
We take reasonable care in running our services. To the fullest extent the law allows, we are not liable for indirect or consequential loss, loss of profit or data, failures by licensed partners or other third parties, or loss caused by credentials or keys you did not protect.
Our total liability for any claim connected with a service is limited to the fees you paid us for that service in the 12 months before the claim, unless the service's own terms say otherwise. Nothing in these terms limits liability for fraud, death or personal injury, or any liability that Malawian law does not allow us to limit.
13. Indemnity
You will cover reasonable losses we suffer because you broke these terms or the law, or because content you submitted infringed someone's rights.
14. Privacy and data protection
How we handle personal data is set out in our Privacy Policy and Data Protection notice. Both form part of these terms.
15. Changes to these terms
We may update these terms. Material changes are posted on this page with a new date. Continued use after that date means you accept the updated terms.
16. Governing law and disputes
These terms are governed by the laws of the Republic of Malawi. We will try to resolve disputes in good faith first. If that fails, the courts of Malawi have jurisdiction. You also keep any consumer protection routes open to you under Malawian law.
